SY 23-26 Swank Public Performance Site License Overview

The Office of Curriculum, Instruction and Student Support has negotiated a significant price reduction for a 3-year Public Performance Site License (PPSL) for SY 2023-2026 to assist schools in complying with copyright law.  Click here to view the official memo: https://bit.ly/SY2326-SWANK-PPSL-MEMO


Interested schools must complete the online request form by Friday, February 10, 2023: https://bit.ly/SY2326-SWANK-PPSL-REQUEST-FORM.  Payments are due by Friday, March 10, 2023.

The Federal Copyright Act (Title 17 of the U.S. Code) governs how copyrighted materials, such as movies, may be used.  The rental or purchase of a movie does not give the right to show the movie publicly outside the home, such as in classrooms or school settings unless the site where the movie is shown is properly licensed for public exhibition.


License Benefits

A Public Performance Site License through Swank Movie Licensing USA will also prevent your school from being cited for copyright infringement when other organizations use your facilities. Many schools are unaware they are held liable for the actions of outside organizations on their school property (i.e. Before/After School Programs, Summer Camps, Parent Groups, etc.) This license ensures your school is protected and follows U.S. Copyright Law when showing films of authorized studios.


Outdoor Events for Schools

Your school may qualify to show an outdoor movie on school property. Check out outdoor programming ideas and submit an event request form at https://www.swank.com/k-12-schools/outdoor/ to get started. Titles covered by the Public Performance Site License are eligible for outdoor showings in most instances.


Benefits include:

  • A safe option for engaging students and families
  • Outside setting means it’s less distracting if kids are loud or restless
  • Appeal to both young and older attendees
  • Have attendees bring a blanket or lawn chair for easy setup!
  • Provides a much-needed escape or change in scenery

Terms & Conditions:

  • Showing must take place on school property.
  • Event may not be open to the general public; attendees must be school employees, families, and students only.
  • Drive-up type showings are not to be offered if a commercial drive-in theatre is within 10 miles of the school.
  • Advertising Guidelines: Event must be advertised directly to students and parents via mail, email, or other direct messaging.
  • The words "drive-in" should not be used. Alternative phrases could be "Wheels and Reels" or "Carpool Cinema.”
  • It is understood that in rare instances it may be necessary for the Studio, in its sole discretion, to withdraw a movie from exhibition.


Authorized Movie Studios


License Agreement Details

  • Covers the school building 24/7 (before, during and after school)
  • Unlimited movie showings by anyone in the school building regardless of whether or not they are affiliated with school
  • Movies may be obtained from any legal source (buy, borrow, rent, stream, etc.)
  • License runs July 1, 2023 through June 30, 2026
  • Cost is based on total student enrollment of the school – refer to HIDOE memo dated November 10, 2022 (https://bit.ly/SY2326-SWANK-PPSL-MEMO
  • The Office of Curriculum and Instructional Design, Library Media Services will coordinate renewal licensing depending on need and interest.
